• Download and print each copy of the digital order for your own use only.

You DO NOT have the right to:

• redistribute the digital product in any form or file format for commercial or any other purposes, or
• alter, edit or tamper with the digital file or print-outs, other than alterations authorised by Vivaldistudio.co.uk.

1b. Physical Products

Vivaldistudio.co.uk reserves the right to change the rights granted in these Terms and Conditions at any time without prior notice.

If products from our online catalogue are removed or changed at any time Vivaldistudio.co.uk shall not be liable to you in any way.

2. Use of products

You DO NOT have the right to:

• Redistribute products to third parties by any means.
• Rent, give or lend products to third parties.
• Perform, show, broadcast (by any means), or play downloaded products in public without first purchasing a licence from Vivaldistudio.co.uk
• Use automated systems for accessing or downloading audio/video tracks, or
• Attempt to circumvent, alter, or in any other way modify any copy-protection technologies.
• Sell items you do not have copyright to. Doing so will mean that you are suspended from using Vivaldistudio.co.uk. Vivaldistudio.co.uk are not liable for your infringements of copyright.

3. Prices

Price information displayed on the Vivaldistudio.co.uk website is subject to change without prior notice.

4. Returns

The sheet music, visual, audio-visual and audio materials offered and digitally delivered by Vivaldistudio.co.uk are deemed to be services (Services) for the purposes of the Consumer Protection (Distance Selling) Regulations 2000. Because of the nature of the Services (and any goods) offered on Vivaldistudio.co.uk, you agree not to exercise any right of return or cancellation concerning:

• The supply of Services which execution has already started (i.e Download has commenced).
• The supply of goods which cannot be returned because of their nature.
• The supply of software you downloaded prior to the commencement of a Download (or acquisition of any goods).

Physical products will have the following refund policy:

• Merchandise bought has a 30-day return policy if there are any defects.
• Because our items are print on demand, please check the order is correct at the time of placing because refunds and not accepted unless there are any defects.
• For defects on print on demand items, you must contact us within 10 working days of receiving the order. Refunds after this time are not guaranteed.

5. Refunds

If you have trouble with your purchased products, please contact us and we will either help you resolve your problem, cancel your order or refund your payment if we are unable to resolve the problem. Vivaldistudio.co.uk shall then have no further liability to you. Please note that refunds are not available on downloadable products.

6. Jurisdiction

All purchases from Vivaldistudio.co.uk are subject to Scottish Law and the exclusive jurisdiction of the Scottish courts.

8. Print On Demand

• You will only own the goods once we receive payment in full.
• You will become responsible for the items as soon as they are delivered to the address you gave us.
• Delivery time and details are available at the checkout.
• Products are usually dispatched within 2 working days, however this maybe slightly longer in busy times or certain circumstances.
• When you purchase a “Print On Demand” product you agree to us passing your name and address to our print provider only in the the business of the supply of the products.

9. Seller Subscription

• All rights and copyrights remain the property of the member that uploaded the product.
• By signing up you agree to pay Vivaldistudio.co.uk 20% commission of the sales of you items.
• It is the members responsibility to make sure the details of their items are correct and up to date.
• Vivaldi Studio cannot held liable for any errors in products by 3rd party sellers.
• You agree to Vivaldistudio.co.uk using your details only in according with advertising and selling your products. We will not share personal details without your prior permission.
• We will keep records of the sales of all your products and this will be available online via your monthly commission statements.
• Commission statements are published on the next working day on or after the 12th Of each month for the previous calendar month.
• Commissions are paid out on 20th of the month, or the next banking day thereafter, in the month which the commission statement is generated.
• You agree to allow us to sell your items on Vivaldistudio.co.uk
• You agree to allow us to advertise your products on various social media and advertising platforms.
• You allow us to display your seller profile on Vivaldistudio.co.uk
• You must maintain a subscription with us to allow us to sell your items on Vivaldistudio.co.uk
• Vivaldistudio.co.uk reserve the right to remove this service from their website at any time. At which point we will remove all traces on your products, delete you information and pay any commissions due to you at the next commission run.
• Your details are held in accordance with the GDPR directives.
• We reserve the right to remove and products at any time.
• Breaking any of our terms and conditions will mean immediate removal of all your account and your products from the website and no commission will be due.
• By signing up to a seller subscription you agree to be bound by these terms and conditions.
• We will provide to you the best service we can offer. Vivaldistudio.co.uk cannot be held responsible for any delays or loss of sales out-with their control.
• It is the sellers responsibility to ensure that they own the copyright for the items sold on the site or that the item is in the public domain. Vivaldistudio.co.uk hold no liability for this.
• We will not be liable to you for any breach of this agreement which we cannot reasonably be expected to control.
• You can terminate this agreement at any time in writing. At such time all your products and personal details will be deleted from out systems and any commission due will be paid out at the next commission run.

9. Licence to Perform

• A licence is required to perform any of the material on our website unless stated otherwise. You need a licence even if you are performing the material to a private audience.
• When buying a licence you will receive a licence application form. Please note that this form must be completed within 6 months of purchase for the license to be granted. After 6 months the license will be revoked, and the payment is non-returnable.
• This license is for up to 7 concurrent days. If you need more days, then please purchase another license.
• A refund will not be given for less days performed.
• Your license will only be valid once this form has been returned to Vivaldistudio.co.uk.
• License only valid with full payment and completed form.
• Our licenses are fixed fee and there is no percentage will be taken off your box office takings.
• There are no refunds on license payments.
• You can only film or audio record if you have purchased this license.
• Your license details will be returned within 7 working days of receiving this completed form and full payment.
• Performing our material without a valid license is against the law.
• This license does not include the scripts, piano/vocal score, soundtracks or backing tracks (Where available) to perform the material. This needs to be purchased separately from Vivaldistudio.co.uk
• You must keep 2 tickets aside, free of charge, if Vivaldistudio.co.uk wish to attend one of your performances. You will be notified 7 calendar days before the first performance date if we will be attending.
